Apparently, it's a big problem in Japan, for things like Brain Training on the NDS, where rival companies rip off Nintendo wholesale - within months, there were copies with nigh identical packaging and colouring, with titles like "Dr Hisuraki's Brain Teaching". Retailers even try to boost sales by putting stickers over the cover to hide most of the title, in efforts to lure the customer into buying a copy.
I reckon it's just not worth the effort on the part of the companies to fight a court battle, one that's unlikely to achieve anything in terms of retraction of games..
